Terms and Conditions of use for the Seef Malls Gift Card. A service provided by Seef Properties.
I. In these Terms: "We" or "us" or "our" or "the Issuer" or "Seef Malls" refers to Seef Malls.
II. In these Terms: "You" or "your" means the person who has purchased a Seef Malls Gift Card and/or the person nominated by the purchaser to use it ("the purchaser" or "Cardholder").
III. The Seef Malls Gift Card Terms & Conditions will apply between you and us in relation to the Seef Malls Gift Card.
IV. The term: "Retail, Retailer or Merchant" refers to a store that accepts the Seef Malls Gift Card as a method of payment.
V. “POS” means Point of Sale Terminal at a retail merchant that is participating in the Seef Malls Gift Card program as an acquiring merchant.
2. About the Seef Malls Gift Card
I. The Seef Malls Gift Card operates through the Point Of Sale Terminals at participating merchants and works in a similar way to any debit card where credit amounts are depleted each time a purchase is made.
II. The Seef Malls Gift Card is a prepaid card and should be treated like cash.
III. Seef Malls Gift Cards are accepted at all participating merchants at Seef Mall in Seef, Seef Mall, Isa Town and Seef Mall Muharraq. A list of participating merchants is available on this web site or please visits our Customer Service Booth at Seef Mall, Seef District.
IV. The Seef Malls Gift Card cannot be used to obtain cash via an ATM.
V. The Seef Malls Gift Card is valid for one year (12 months) from date of purchase, after which, the Seef Malls Gift Card is not re-useable or reloadable.
VI. The Seef Malls Gift Card is non-refundable and non-reloadable cannot be exchanged for money, credit or otherwise, nor can it be refunded after purchase. When the balance reaches zero, the card cannot be used further.
VII. The Seef Malls Gift Card can be loaded in increments of BD5.000 and has no maximum limit.
VIII. The Seef Malls Gift Card may be used at participating merchants within the Seef Malls Retailers and is not liable if you are unable to use the Seef Malls Gift Card with any retailer.
IX. Seef Malls are not liable for any goods and/or services purchased from any retailer when using the Seef Malls Gift Card. All goods and or services are covered under the retailers return of goods policy or warranties.
X. Seef Malls cannot guarantee that all of the retail merchants who have agreed to accept the Seef Malls Gift Card will continue to accept the Seef Malls Gift Card; however, Seef Malls Management will do their best to ensure there is a good network and variety of retail merchants for Gift Cardholders to spend at.
3. Using The Seef Malls Gift Card
I. The Seef Malls Gift Card can be purchased at the nominated guest services desks within Seef Malls.
II. If the user is under 16 years of age, the purchaser agrees to ensure that these Terms & Conditions are understood by the user and that use of the Seef Malls Gift Card is supervised if required.
III. The user is responsible for keeping track of the available balance on the Seef Malls Gift Card. To check your balance, you can ask participating retailers or the Customer Service desks to check the Gift Card balance on the POS Terminal.
IV. Transactions that exceed the available Gift Card balance will be declined at the point of sale. However, if the retailer accepts, the Cardholder can be used to pay some amount on the Gift Card and the balance in cash or card depending on the Retailers in-store policy.
V. Seef Malls are not liable for any failed transaction or if the POS terminal or Gift Card system is not working properly.
VI. If there is a problem or dispute with a purchase of goods or services, you must address it directly with the merchant involved.
VII. In case of other errors on your Seef Malls Gift Card, you can contact us on +973 1758 1111 or visit us at the Customer Service Booth.
4. Lost, Stolen or Damaged Cards
I. If the Seef Malls Gift Card is lost or stolen, you can immediately call +973 1758 1111 to block the card. If there is a balance on the card at time of blocking, a new card can be issued so long as the purchaser can provide sufficient ID and/or proof of purchase or ownership.
II. If lost or stolen and some or all of the balance of the Seef Malls Gift Card has been spent prior to informing Seef Malls and Seef Malls blocking the card, then Seef Malls will not be liable for the amount that has been spent.
III. If the Gift Card becomes damaged and unusable, a replacement Gift Card can be arranged by visiting Customer Service at Seef Mall and the remaining balance can be loaded to the new Gift Card.
5. Unspent Funds
I. Card holder is required to use the complete value loaded on the Seef Malls Gift Card before the expiry date which is 12 months from the date of purchase. No extension of date will be granted.
II. After the expiry date, any remaining balance on the Seef Malls Gift Card cannot be claimed and will have to be forfeited by the card holder.
6. Changes to Terms & Conditions
I. Seef Malls reserve the right to change the terms & conditions without prior notice to benefit and improve the program including adhering to any Bahrain laws.
7. Information About You and its usage
I. By using the Seef Malls Gift Card, You authorize and permit Seef Malls to disclose and provide information about you including the Gift Card to Seef Malls authorized representatives, assignees, agents or other connected parties including the Issuer's third party advisers and marketing partners.
II. By using the Seef Malls Gift Card you or the recipient of the Gift Card accept that your information may be used to send you special offers, discounts and notifications related to the Gift Card program for the purpose of cross selling and marketing of goods and service to you. If you do not wish to have marketing material sent to you, you have the option of deselecting the value added service by notifying the Issuer in writing including your Gift Card number.
8. Governing Law and Jurisdiction
I. These Terms & Conditions are governed by and shall be construed in accordance with the laws of the Kingdom of Bahrain and are subject to the non-exclusive jurisdiction of the civil courts of the Kingdom of Bahrain.
9. Force Majeure
I. If Seef Malls is affected by a Force Majeure they shall not be deemed to be in breach of these Terms & Conditions or be liable of any of its obligations hereunder to the Gift Cardholder for any delay in performance, or non-performance, to the extent that such delay or non-performance is due to any Force Majeure.
II. Continuation of Force Majeure. If a Force Majeure event prevails for a continuous period in excess of 6 (six) months and Seef Malls are unable to operate the Seef Gift Card Program and if they are in a position to do so, may choose to refund any unused or unspent Gift Card amounts of any Gift Card that was active at the time the Force Majeure event started.
